Terms & Conditions for Buyers

Please read the following carefully before bidding:

(1) These Conditions, together with any which may be detailed in any other Notice to Purchasers issued with this catalogue, or displayed for the attention of Purchasers elsewhere, are the only Terms & Conditions subject to which Northern Realisations Ltd, ( referred to hereinafter as "the Auctioneer"), as Agents for the Vendor, will sell goods to a purchaser (referred to hereinafter as "the Bidder"). All other conditions as may be lawfully excluded, are hereby excluded.

(2.) Auction Practice

The Auctioneer may, at its discretion, or upon the instructions of the Vendor:

(2a) Alter or withdraw any or all lots referred to in this catalogue up to the time that the hammer falls in relation to such lots.

(2b) Withdraw from sale any lot upon which a reserve price has been placed, when the highest bid does not meet the reserve.

(2c) Where two or more consecutive lots are similar in quantity and description, offer the bidder of the first item the option of taking the second and, (if it wishes) subsequent lots or any of them), at the same price.

(2d) Each lot shall be sold to the highest bidder and in the event of a dispute arising between bidders, such dispute will be resolved in such manner as the Auctioneer may in its absolute discretion determine.

(2e) Bidding will be regulated by the Auctioneer in such manner as it may think fit and, without prejudice to the generality of the foregoing, the Auctioneer may refuse to accept any bid, or may itself bid on behalf of any Third Party.

(3) 10% Buyer’s Premium

The Buyer will pay the Auctioneer a Premium of 10% plus VAT at the prevailing rate upon the "Hammer Price" of each lot. The Premium is not negotiable, and is payable by all purchasers. The Bidder also agrees that the Auctioneer may also receive Commission from the Vendor.

(4a) The Auctioneer may request a further deposit from any successful bidder at any time following the fall of the hammer upon an item sold to that bidder. Such deposit will be held as a deposit against all the goods sold to that bidder.

(4b) The balance of Purchase moneys due from each bidder must be settled not later than the close of business 3 days after the auction . Goods not collected by the stipulated time will incur storage charges.

(6) VAT

The Price at which the Bidder purchases each lot will be inclusive of VAT where applicable

(6a) Where the Bidder intends any lot to be exported outside the UK, a refund of VAT will, (subject to whatever regulations made from time to time may be in force) be made, subject to the production of whatever proof of export the Auctioneer may require.

N.B. The attention of Bidders is brought to HM Customs & Excise regulations which dictate a limit of time within which goods purchased must be exported in order for a valid claim for a refund of VAT to be made.

(7) Clearance of Purchases

The Bidder will only remove lots from the Auctioneer’s premises at the direction of the Auctioneer, and within the time set by the Auctioneer for the clearance of goods. No lots will be removed by any Bidder until that Bidder has settled his account for all lots purchased.
